Experienced Legal Counsel For Home Owner Associations And Other Common Interest Developments

The success of any community development project depends upon complying with state and federal law. At Liberty Law, A.P.C., we have worked with and represented a wide range of common interest development groups in Red Bluff, Redding and throughout Northern California. This includes homeowners’ associations,  planned unit developments, shopping centers, and many more. We also understand that in today’s economy, developers need sound legal counsel at an affordable price. Our flat fee pricing models are designed to meet your specific needs without incurring unnecessary costs. Contact us today to learn more about all of our community development services.

The Davis-Stirling Common Interest Development Act

As you know, this act refers to the portion of the California Civil Code that governs condominiums, cooperatives, and planned out development communities in California.   It addresses the laws, rules, and regulations for developing a homeowner’s association or community development project, together with how to run and manage such an association or project. The act requires a developer to record a Declaration of Covenants, Conditions & Restrictions (CC&Rs), which serves as the constitution for the HOA and lays out the rules and regulations for living in the development (although the development group’s Board has the authority to add rules or charge certain fees to homeowners as long as they do not violate or conflict with state or federal law). The CC&R is a legally binding document, and all homeowners in the community must abide by its terms or face monetary penalties.

For assistance in drafting HOA documents, policies and enforcement procedures, please feel free to contact us at your convenience. We can also help you with enforcement actions on existing policies and governing documents. After all, the enforcement component is the key to maintaining the integrity of the Association.
